Conditions and rules for using the platform.

1. Acceptance

By using HistogramIQ, you agree to these Terms of Use, which govern access to the software and related services. If you do not agree, do not use the platform.

2. Description of the Service (SaaS)

  • Free: access to the chatbot and to the scanner focused on detecting opportunities per asset, with notifications. Does not include automatic order execution.
  • Starter: includes the features of the Free plan and adds automatic per-asset execution through an Expert Advisor (EA) in MetaTrader 5, based on parameters defined by the user.
  • Semi-Pro: includes the features of the Free and Starter plans and adds multi-market/multi-asset scanning and notifications through a service integrated with MT5. Automatic execution remains limited to the per-asset level, according to the user’s configuration and the broker/platform rules.
  • Pro: includes all previous features and enables multi-market/multi-asset automatic execution through the service integrated with MT5, according to the rules and parameters defined by the user.

The Starter, Semi-Pro, and Pro plans are offered asmonthly or annual subscriptions. The Free plan is free of charge and may be subject to limitations, changes in features, or discontinuation without prior notice. No plan is offered as a perpetual license.

Nature of the software: HistogramIQ provides automation and analysis software. It is not a broker, does not provide investment advice, and does not intermediate, clear, custody, or guarantee transactions. The content is strictly educational/informational. See theDisclaimer.

3. Account & Eligibility

Use requires registration, legal capacity, and compliance with applicable laws. You are responsible for credential confidentiality and all activity under your account.

4. Subscriptions, Billing & Cancellation

  • Basic and Pro have recurring monthly or annual billing via a payment processor (e.g., Stripe). Taxes may apply.
  • Subscriptions renew automatically until cancelled. Cancellation applies to future periods; unless required by law, amounts already paid are non-refundable.
  • Trials, discounts, and/or coupons may be offered; specific terms may apply.
  • The Free plan may be suspended, modified, or discontinued at any time.

5. License & Activations

A non-exclusive, non-transferable, revocable license is granted according to your active plan. On Pro, the MT5 EA may require per-terminal/installation activations (“activations”). The default limit is stated on the pricing page; unauthorized sharing is prohibited. Contact us for additional needs.

6. Acceptable Use & Limits

  • No reverse engineering, abusive scraping, bypassing technical limits, circumventing access controls, or infringing intellectual property.
  • We may enforce technical limits (e.g., number of monitored symbols, analysis frequency, chatbot/API usage) to ensure stability and fair use.

7. Compliance & Responsibility

You are responsible for ensuring that your use — including automated execution via EA — complies with your broker/platform rules and all applicable laws/regulations. HistogramIQ is not responsible for your configuration, strategy, compliance, or tax obligations.

8. Risks & Disclaimers

Trading involves significant risk. Past performance does not guarantee future results. The software may fail, be unavailable, experience delays, include third-party data errors, or be affected by external events. To the maximum extent permitted by law, HistogramIQ does not guarantee performance and is not liable for losses arising from use. See the Disclaimer.

9. Availability, Support & Updates

We may update, modify, or discontinue features at any time. We use reasonable efforts for availability and support without a guarantee of continuous uptime.

10. Intellectual Property

The software, documentation, and trademarks belong to HistogramIQ or its licensors. No rights are assigned except the limited license granted herein.

11. Privacy

Personal data processing follows our Privacy Policy. By using the platform, you consent to that processing as described.

12. Termination

We may suspend or terminate access in case of breach, legal requirement, or operational risk. You may terminate at any time by cancelling your subscription (if applicable).

13. Changes to the Terms

We may update these Terms. The current version is 2025-08-24. Material changes may be communicated; continued use implies acceptance.

14. Governing Law & Venue

These Terms are governed by the laws of the country/state where HistogramIQ is organized, without regard to conflict-of-law rules. However, if you are acting as a consumer, any mandatory consumer protection laws of your country of residence will still apply. Courts located at HistogramIQ’s principal place of business shall have jurisdiction, unless mandatory consumer protection rules grant you the right to litigate in your place of residence.
